The Regulatory Reform (Fire Safety) Order 2005 came into force on 1st October 2006 and applies to almost all types of premises and occupancies. It does not apply to individual homes or flats.

New Responsibilities
It requires the responsible person to take adequate steps to identify, reduce and manage the risk from fire and ensure that all persons on the premises can safely escape from fire.
This is different from all previous fire safety legislation in that it requires the 'responsible person' to consider all persons not just employees. This Order also sweeps away all previous legislation so even if you have carried out a fire risk assessment before you must ensure it takes into account the scope of the new Order.
Local authority fire brigades will be responsible for enforcing this Order and like previous legislation they have the right to impose notices of improvement and ultimately they have recourse to the courts. It is worth bearing in mind that contraventions against fire safety legislation are criminal offences and carry significant penalties which can include fines and or imprisonment.
